Cherry Hill Construction Accident Lawyers: Settlement for Ironworker Injured in Construction Fall Accident
May 25, 2015
Nine years ago, an ironworker suffered injuries when a steel beam struck the scaffolding he was standing on, causing him to fall at the Princeton University construction site. The case was recently settled during jury deliberations after a five week trial. The general contractor agreed to a $1.2 million settlement for the injured construction worker. This case is a noteworthy reminder to general contractors who utilize subcontractors that they, as the lead contractor on a project, are the responsible party for preventing construction accidents.
The 54-year-old ironworker, who had been hired to help build Princeton University’s Lewis Science Library in 2006, was working on top of a ten-foot scaffold when a relieving angle, weighing 600 pounds, struck the scaffolding, causing him to fall at the construction site. In addition to suffering a concussion, the ironworker was diagnosed with post-traumatic stress disorder (PTSD.) Shortly after the incident, the construction worker filed civil lawsuits against Princeton University, his employer Central Metals, and the general contracting company Skanska. The case against the University and the subcontractor were dismissed by the judge based on his ruling that it is the responsibility of the general contracting firm to provide all workers with an OSHA compliant worksite.
The Federal Occupational Safety and Health Administration (OSHA) ensures safe and working conditions by setting and enforcing labor standards. The Occupational Safety and Health Act of 1970 seeks to provide workers with a safe working environment free from dangers or hazards in order to prevent injuries and accidental deaths.
